Bail Bondsman in Alhambra, CA

JR’s Bail Bonds Alhambra – 24/7 Bail Bond Services

The police can arrest and detain your loved one pending trial or further investigation if he/she is accused of committing a crime. While in custody, a defendant undergoes different processes to enable the law enforcement officers to gather more information on the identity and the charges the defendant faces. The trial can take months or even years to complete; thus, seeking pre-trial release for the defendant is essential. One option for helping your loved one leave custody is posting bail in exchange for the defendant’s freedom. You should work with an experienced Alhambra bail bondsman for a smooth and easy process if you opt for bail. JR’s Bail Bonds offers accessible bail bond services 24/7 to ensure we are available whenever you need us.

What The Bail Release Procedure Entails

When the police arrest a defendant for violating the law, they stay in custody until they complete their investigation and booking process. Afterward, your loved one can be released as he/she waits for trial based on the constitutional right not to face arbitrary detention.

Before your loved one leaves the detention facility, he/she must meet several requirements to show the willingness to adhere to the law upon being released. Posting bail is the best way for your loved one to leave jail.

The court and police understand the importance of promoting a defendant’s right to a fair trial, including setting them free after arrest. However, the defendant must adhere to the legal procedures and obligations while waiting for trial. The bail system allows arrestees to leave custody once they post a specified amount as collateral.

Once you post the prescribed amount as bail, your loved one must commit to honoring the scheduled court hearings to promote the case’s progression. Court attendance is essential for the case to proceed in the interest of upholding a fair trial. You could lose the amount committed as bail if your loved one skips the court hearings. Your loved one can also be re-arrested and placed in custody as further punishment.

Once the proceedings conclude, the judge will evaluate your loved one’s performance in adhering to the court orders before you are refunded the money you posted as bail. You will be refunded the full amount if the defendant complies with all the court orders. Absences and other forms of misbehavior could lead to non-reimbursement.

The Procedure Of Posting Bail

The police can have probable cause to arrest your loved one after witnessing or receiving information that your loved one has committed an offense. The arrest and detention of a defendant gives the police ample time to investigate the case further. This also helps them gather enough information for the trial.

Your loved one will stay in jail at the local detention facility after arrest, and the officers in charge will commence subsequent procedures. The booking involves securing information about your loved one’s identity, criminal record, and other essential information to help the prosecutor during the trial.

The arrestee takes mugshot photos for identification and fingerprints for the biometric records. The officers can order your loved one to give information like phone number, workplace address, and home address.

During booking, the officers will also determine if your loved one has a criminal record by running his/her name in the database. The officers often do this to obtain crucial information that justifies the need for a trial, particularly if your loved one is a repeat offender.

An arrestee can exercise his/her right to a phone call after the booking. The officers will allow this so your loved one can notify a trusted third party of the arrest. This also helps you prepare to bail your loved one out of custody. If you have no money to post bail, you can contact an Alhambra bail bondsman for the required support.

You can also request the officer in charge of the bail schedule to help you estimate the amount required to release your loved one on bail. The schedule is a preset document that shows a range of bail amounts for all recognized crimes that can attract an arrest. You can prepare your bail bondsman if you have this information beforehand.

What Bail Hearing Entails

You will know the bail hearing date for your loved one once he/she arrives at the detention facility. This will help your loved one prepare for the court appearance. The law allows the officers to process your loved one for the hearing within 24 hours of arrest. However, this might happen if a defendant is arrested on a holiday or weekend.

The bail hearing often starts with the defendant taking a plea. The defendant can plead guilty or not guilty to the accusation leveled against him/her. If your loved one ‘’pleads guilty’ he/she has accepted the charges, and there will be no trial and no need for bail. Your loved one can be convicted during the same hearing, or the judge can set another date after the initial bail hearing.

On the other hand, pleading ‘’not guilty’’ means your loved one has denied the accusations against him/her. If this happens, the defendant will proceed to trial. You will be required to bail your loved one out of custody so that they can prepare for the upcoming trial. The attorney will advise your loved one to plead not guilty, allowing them to justify their position and challenge the accusations.

How To Post Bail

You can use various ways to post bail for your loved one based on your access to property or finances. Your attorney can give you more insight into the following options, including merits and demerits for each:

Working With An Alhambra Bail Bonds Company

Working with a bail bondsman is the most convenient way if you want your loved one to leave custody in the shortest time possible. The professional role of a bail bondsman involves securing the release of arrestees by posting bail. Unlike working alone, a bail bondsman will expedite securing the release of your loved one.

Bail bondsmen also understand the documentary requirements you should provide beforehand. An Alhambra bail bondsman will help you prepare your application immediately after you call him/her. He/she will also be available to guide and update you on the bail process.

Providing A Property Deed As Collateral

Sometimes, you can fail to access cash immediately but have an asset whose value is commensurate with the bail amount. You can apply for the court’s bail by surrendering your title to the asset as collateral in exchange for the release of your loved one. This is a viable option, but the judge will ask you to undertake several bureaucratic steps to prove that the asset belongs to you. Often, this will take a more extended period, forcing your loved one to stay behind bars for longer than necessary.

Posting Bail In Cash

Posting a cash bail for your loved one requires you to pay the whole amount set by the court. You can pay with liquid cash or call a trusted family member to support you. This option is the quickest and presents no challenges. However, sometimes, it can be challenging to raise this amount within a short period if the bail amount is high.

Presenting a lot of money in court can also attract extra security for your financial records. You could attract additional attention, particularly if your loved one is accused of money laundering, drug trafficking, or drug sales.

How A Bail Bondsman Posts Bail

Once you reach out to an Alhambra bail bondsman, he/she will process your case fast to ensure your loved one is released promptly from custody. You must provide crucial information about your loved one during the initial interaction with the bail bondsman. The information a bail bondsman will require includes:

  • The name of the defendant
  • The date when the defendant was born
  • The address of the defendant, and
  • The charges your loved one is facing

If the defendant is employed, the bail bondsman can also request that you provide the workplace address for future reference. The bail bondsman will notify your loved one’s supervisor about the detention.

Bail bondsmen are professionals. You must give additional information if your loved one’s case involves unique circumstances. For example, in sexual offense charges, gender and the age of your loved one are vital. You must provide accurate information.

The bail bondsman will also disclose the conditions of the bail service you will secure to assist you in making sound decisions. He/she will mention the service fee, often 10% of the bail. You should deposit the service fee with the bail bondsman before your loved one is released.

The service fee is lower and more affordable than posting the bail, but the corresponding amount can still be expensive if bail is high. As a result, you can negotiate a repayment plan to help you secure the release of your loved one as you structure your finances. The defendant will be released once the bail bondsman posts the bail. In return, you will start your premium repayment plan until you fully pay.

Penal Code 1275 Holds In Alhambra

According to Penal Code 1275.1, the judge can reject the money you use to bail your loved one if he/she suspects that the source of the money is from a criminal activity. This is referred to as a 1275 Hold. The police or prosecutor can put the Penal Code 1275 hold on your loved one’s bail. They will do this if they are convinced that the money you are using to bail your loved one out is the proceeds from an illegal activity. The money can be from extortion, theft, embezzlement, gang-related activities, or drug dealing. These acts will make the amount that comes from them ineligible for posting bail.

The court will schedule a hearing if a 1275 Hold is put on your loved one’s bail. During the hearing, the judge will determine if the money you used to bail your loved one came from illegal sources. You will be required to provide the following to prove that the money you used is ‘’clean’’:

  • Proof of income
  • Tax returns
  • Car payment information
  • Bill payment statements
  • Bank and credit card statements

GPS Monitoring For Bail Bonds In Alhambra

If your loved one is arrested and the court sets a high bail, you can save money if he/she accepts PS monitoring as part of the bail bond agreement. The judge can lower the cost of bail because GPS monitoring will become a part of your loved one’s bail agreement. Sometimes, it is challenging for a bail bondsman to come up with a reasonable premium, especially if the bail is high. However, an experienced bail bondsman can develop a suitable payment plan for you. GPS monitoring can significantly reduce the cost of posting bail for your loved one.

Bail For Violating Restraining Order In Alhambra

One of the leading causes of arrest in Alhambra is violating the conditions of a restraining order. Violating a restraining or stay-away order is a misdemeanor crime under Penal Code 273.6. Your loved one can face a jail term or a fine if guilty of this offense. Violating a restraining order can attract a higher bail because it is considered contempt of the court. The defendant could face high bail amounts of between $15,000 and $150,000 if arrested for violating Penal Code 273.6.

My brother in law was arrested. We were having a hard time getting any information from Carson Sheriffs department. Despite their rudeness. We had called several bailbonds and no one seem to help. When I called JR’s bailbonds and spoke to Sullivan, he seemed very professional and helped us and answered every question we had. He kept staying in touch with us throughout the process until my brother in law was out. I highly recommend them.

I like this company because they are sincere and honest, and very kind with there customers. When someone ask them for help, and they see the sadness and pain of the mother or family members of the person who’s in jail they go out of their way to put a smile back again on those person’s face. That’s what their main objective is more than the money to bring their clients smiles again by reuniting their loved ones back together. So if anybody ever needs help, I highly recommend this honest and wonderful company.
